MyDearest Privacy Policy

Welcome to MyDearest.

 

MyDearest (the “Service”) provides a service that allows you to share your location, share mobile application usage reports, share calendar events, and to message with users that you have added as a family member or Dearest on our application. Some of the features of MyDeaerst are only available on the Android version and currently are not available on the iOS version of the Service. MyDearest is a product of Dewmobile USA, Inc. (“Dewmobile”, “we”, “our”, or us”). Dewmobile recognizes that your privacy is important and your personal information must be protected.

 

This privacy policy explains how we collect, use, share, and protect information related to MyDearest and how you control this information. This privacy policy only pertains to our application MyDearest and does not cover other applications made by DewMobile or our website. You can find the privacy policy for our other applications and our website at www.izapya.com/policy_en.html.

 

MyDearest is available in multiple countries that have different standards and requirements regarding the information we provide in this privacy policy and how we use personal information. Numerous provisions and/or practices may be required because of laws, international treaties, or industry practices. Before you download and start using our Service, please make sure you have carefully read and understood this privacy policy. Whenever you use our Service, it means that you have agreed to be bound by this policy and our Terms of Use (which can be found at https://www.izapya.com/Agreement). The bolded term “Dearest” will be used throughout this privacy policy and is an application specific term that refers to when someone has entered a caring relationship with another user and whoever is deemed “Dearest” has their location data constantly shared with the other user.

 

1.     Information We Collect

 

    We collect information every time you communicate directly with us, transfer files, and post content on our Service for your convenience. We collect the following types of information:

·       Registration and Profile Information. (Avatar image, username and/or first name and last name, contacts, Dearest, email address/mobile phone number)

·       Location

·       Chat History

·       User Data (information about your Device, applications that you use, Moments, etc.)

·       Calendar Events

·       Non-Personal Information (phone IMEI number, phone model, rom, phone operator, location, operation system, etc.)

·       Communications between you and Dewmobile (emails, mail, feedback, etc.)

 

    Registration and Profile Information. We collect all the information you provide us when you register an account on our Service. This includes any personal information that you voluntarily submit on our Service or share with others on our Service such as your mobile phone number, your first and last name, email address, birthday, etc. You have the option to customize your experience by saving locations as “Work”, “Home”, and “School” on your map and we collect this data to link it with your account.

 

    Location. The main function of our Service is to provide you with the means to share your location with others and to view the location of your family members. We collect your location information using your device’s IP address, WiFi, Bluetooth, and GPS coordinates. We only collect your location information to support the map, Location Report, and sharing your location features of the Service. We do not share your location with anyone besides those you have specifically asked to share it with. If you do not want to share your location data with others, you can either disable the location permission for our Service, not become another user’s Dearest, voluntarily chose to not share it within the group chat, or not send others your Location Report. We require access to your location in the background so that those you have given permission to view your location on the Map are able to view it when you do not have the Service actively open on your device.

 

    Chat History. We collect information when you message any of your contacts through our Service. We store your chat history so that whenever you access the Service you can view messages that you have sent and received. We only retain this information to provide you the features and functionality of the Service and to notify you when you have messages.

 

    User Data. If you are using the iOS version of our Service, you can disregard this section. On the Android version of our Service you have the option to receive App Usage report about the amount of time spent using applications on your and your Dearest’s mobile device. Your user and device information are processed on your behalf so that we can provide the monitoring function of our Service. By using this function of our Service, you warrant that you have informed any users that are 13 years old or more that the device used by them include a control and monitoring software when you add them as one of your Dearest on our Service and have obtained authorization from such users for this kind of activity, as provided in this Privacy Policy. Only with their consent can you view their App Usage report. Both the Service and you agree to fully comply with this Privacy Policy. If you no longer wish for someone to receive your App Usage report, you must exit the caring relationship you are in with them and stop being their Dearest.

 

    Calendar Events. We collect information about events planned in the chat on our Service to operate, maintain and provide to you the group calendar feature. This allows you to maintain a calendar with group members so that you can all stay informed about events or happenings within the group. We do not share this information with any third parties outside of the other members of your group.

 

2.     Application Permissions

All the permissions our Service requests access to are directly linked to the features offered on the application. Some of the permissions our Service requests the use of are subject to the Personal and Sensitive Information policies on both Google Play and Apple. We been authorized by Google Play and Apple to request these permissions from you. If we did not have their authorization to include these permissions, our service would not be listed on their app stores.

You can find the detailed explanations for why our Service requires these permissions in the Appendix section of this policy. The permissions required for our Service to function fall under two categories: permissions requested by the Android version and permissions requested by the iOS version. Please know that by not allowing access to the requested permissions, the features that are related to those permissions will not function properly.

3.     How We Use Your Information

 

    Besides the specific uses of information we describe in this Privacy Policy, we may use the information we collect to:

·       Help you access your information after signing in

·       Remember information in case of accidental deletion

·       Operate, maintain, and provide specific features of our Service

·       Personalize our Service

·       Monitor and analyze trends and usage

·       Identify and fix bugs and other technology problems

·       Enhance the safety and security of our Service

·       Develop and test new features on the Service

·       Enforce our Terms of Use and comply with legal requirements

 

4.     Sharing Information

 

    We will not rent or sell any of the information we collect from you to third parties. We only share your information with your contacts, your Dearest and a third-party data analytics software development kit (“SDK”).  However, the information we share with your Friends and the third party is different.

 

    Contacts. Once you have added someone as a contact on our Service, they have access to your nickname, avatar, the user content you post on your Moments, anything that you send to them in the chat, and any App Usage reports or Location Reports you voluntarily choose to send them. You are in sole control of what information you decide to post and share on the Service. Please keep in mind that if you remove information from the Service, it is possible that one of the users you added might have a screenshot of it or have a saved copy of this information.

 

    Dearest. When you enter a caring relationship on the Service and become another user’s Dearest, your location data and App Usage report will always be shared with the other user. They will receive real time updates of your location on their application even when you have your location turned off in the group chat you share with them and possibly others. If you do not wish for someone else to always receive your location data and App Usage report, you either should not become another’s users Dearest or if you already have become another user’s Dearest, you must request to end that relationship.

 

    SDK. We only share non-personal information with the SDK so that it can help us measure traffic. We collect and use your non-personal information along with information from other users so that the information cannot be directly associated with any specific individual.  The SDK provides us with analytics information that helps us to better understand user behavior and how the Service is performing.

 

5.     How You Control Your Information

 

    Your privacy is important to us and we want to make sure that you are in control of the information you share with us. We currently provide the following ways for you to control your information and are working on providing you with more options:

 

    Deletion. If you wish to delete your account, including all the information associated with it, go to the Settings on the Service and select “Delete Account”. Once you have sent in the request, make sure to not open the application up until seven days after you have made the request. Following your request for termination of your account, we will retain your account information for seven days in case you change your mind. After those seven days are over, all your information will be erased permanently.

 

    Revoking Permissions. At any time you can go to the settings on your mobile device in order to revoke permissions used by the Service. Please understand that if you disable certain permissions, certain features of the Service may not function properly. Most of the features of the Service will not function if the location permission is turned off.

 

6.     Security

 

    We are very concerned about safeguarding the confidentiality of your information. As stated before, we do not collect personal information. In order to protect the non-personal information we collect from unauthorized access and use, we employ administrative, physical and electronic measures. We are well equipped to handle personal or sensitive user data securely, including transmitting the data to backend server using modern cryptography over HTTPS.

 

    Please be aware that the security measures that we take to protect your information are not absolutely guaranteed to counter unauthorized access or use of your Non-Personal Information. Thus, we must insist that you do not share sensitive information on our Service. We ask that you not send us or disclose any sensitive Personal Information (e.g., information related to racial or ethnic origin, political opinions, religion or other beliefs, health, sexual orientation, criminal background, or membership in past organizations, including trade union memberships) on or through our Service.

 

7.     Children

 

    Our Service is not meant for and is not directed at children under the age of 13. Even though our Service is not meant for them, we still advise that if a child under the age of 13 does use our service, that they are supervised and have the consent of their parent or guardian. We do not have a way to verify the age of our users as a part of respecting our user’s privacy, however if you are a parent or guardian and wish to delete your child’s account, please contact us. Please note that to protect the integrity of the Service, we will need to verify your identity before processing your request.

 

8.     California Residents

 

    Under the California Consumer Privacy Act, users from California have the right to request that we disclose to you the Personal Information we collect, use, or disclose about our data practices. You also have the right to request deletion of the personal information we have collected and we cannot discriminate against you for exercising these rights. Please note that to protect your privacy and the integrity of our Service, we will need to verify your identity before processing your request.

 

9.     European Union and Switzerland Residents

 

    According to the European Union General Data Protection Regulation (GDPR), citizens of the European Union have the right to access, erase, correct, restrict processing, retain and reuse of their personal data collect by companies. You also have the right to be informed on how your personal data is being used. You can exercise your rights by contacting us at service@dewmobile.net. Please note that to protect your privacy and the integrity of our Service, we will need to verify your identity before processing your request.

10.  Changes to this Privacy Policy

 

    To ensure the quality of your experience and your security, we will be updating our privacy policy as needed. Any changes made to this policy will not reduce your rights in anyway. If the changes to this policy are significant, a notification will be shown on the application. However, smaller changes may be made so please review this policy periodically.

    If you do not agree to any changes to this policy, you should immediately stop using any of the services we provide and contact us. Your continued use of our service after changes to this Policy have been made mean that you have accepted the terms of the revised Policy. Please note that none of our employees or agents has the authority to violate any of the rights that have been laid out in this policy.

13.  Appendix

 

The following are detailed explanations for the permissions MyDearest requests access to:

 

Location. As a precise family locator, the Service uses the location permission to retrieve your current location and all the locations you visit awhile carrying your phone. The Service uses your real-time location to show your current location on the Map section. If you have granted the Service permission to share this location with others, it will also appear on their Map section. The Service records all the locations you visit to generate an accurate Location Report that you can share with others or keep to yourself. If you are someone’s Dearest, you have agreed to have your Location Report to be automatically shared with your caregiver.

The Service will use location in the background to record the places you visit on your Location Report, show your current location on your family member’s maps, and send notifications whenever you enter or leave a Safe Zone.

 

Camera. The Service uses the camera permission to access the camera on your device to capture images and/or videos. The camera permission must be enabled so that you can scan QR codes to join a group or add someone as your Dearest. It is also used to capture and post images in the chat or as your avatar image.

 

Calendar. The Service uses the calendar permission to access your device’s calendar and save calendar events to it. The Service offers a group calendar feature where you and your family members can plan events and activities together. Without access to this permission, the Service will not be able to save the events to your device’s calendar.

 

Photos. On the iOS version of the Service, the Service requests access to the photos permission so that when using the Service you can access the photos on your device so that you can upload them to the chat or as your avatar. With iOS 14 and above, you have the option to control what photos the Service can access. You can select whether the Service can access your full photo library, only photos that you select, or none.

 

Phone State. On the Android version of the Service, the Service requests access to the phone state permission so that it can identify if you are using mobile data or Wi-Fi. It is also used to identify your device so that the Service can register that the device is associated with your account. Users may have multiple devices that are linked to their account since they can login with their phone number, WeChat account, or Apple ID.

 

Microphone. The Service access to your device’s microphone so that you can record audio when you are filming a video to send in the chat.

 

Display Floating Window. On Android devices, the Service requires you to enable it to display floating windows so that the screen lock and remote screen sharing to work properly. This permission must be enabled on both devices for the features to work. Without this permission, you will not be able to use the screen lock or remote screen sharing features.

 

Storage. On the Android version of the Service, the Service requests access to your device’s storage so that it can identify all files saved on the device and save files on to your device. You have the option to share files in the chat on the Service. Without access to this permission, you will not be able to share or download files using the Service.
